Terms of Service

1. Acceptance of Terms
By accessing or using the Whistle Works platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including sports associations, clubs, and administrators.
2. Description of Service
Whistle Works provides a cloud-based software platform for referee and official scheduling, assignment, communication, and payment management. The Service is intended for use by sports organisations and associations.
3. Accounts and Eligibility
You must be at least 18 years old and have the authority to bind your organisation to enter into these Terms. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
4. Fees and Payment
Whistle Works charges a per-game fee as described on the pricing page. Your first 5 games are free. A valid payment method is required at signup, and charges begin from game 6. Fees are subject to change with reasonable prior notice.
All prices are displayed in the currency applicable to your region. Applicable taxes (including GST for Australian customers) will be added where required by law.
5. Acceptable Use
You agree not to misuse the Service. Prohibited conduct includes: attempting to gain unauthorised access to any part of the Service, uploading malicious code, violating any applicable laws, or using the Service to harass or harm others.
6. Intellectual Property
All content, features, and functionality of the Service are owned by Millennium Data Systems Pty Ltd (trading as The Common Sense Agency) and are protected by Australian and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or create derivative works without our express written permission.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
8. Termination
You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period as required by law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Whistle Works and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other non-excludable consumer protection legislation.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia for the resolution of any disputes. We also acknowledge that some customers may have additional rights under local laws in their jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
